XinTel Sdn Bhd (hereinafter referred to as “the Company”) reserves the right to approve or reject the application for this account. Upon approval, the account shall remain open until terminated by the Customer by written notice.

The use of any service provided by the Company to any person who has registered for the same(hereinafter referred to as “the Customer’) for the benefit of himself constitutes acceptance of the terms and conditions listed below.

1. By registering for the service, the Customer irrevocably acknowledges and agrees that:-
   1. The company shall not be liable for any loss, physical injury, illness, costs or damages resulting from the use of the registered service.
   2. The customer shall not hold the Company liable for any loss if the Company
      is not able to perform its obligations under this Agreement due (direct or indirectly) to the failure of any machine, data processing system or transmission link, or civil or industrial dispute, Act of God or due to any other event beyond the reasonable control of the company, its servants, agents or sub-contractors.
   3. The Company shall not be liable for any loss (whether direct, indirect, incidental, special punitive or consequential )or damages suffered by reason
      of the Customer use or inability to use the Service or any disclosure (inadvertent otherwise) of any information concerning the Customer or for any error, omission or inaccuracy with respect to any information so disclosed.
   4. The customer is responsible for all charges using the service from the registered phone number or pin, unless it’s a billing error.
   5. Confidentiality of the PIN is the Customer’s responsibility.
2. The Company shall have the right to amend, modify or supplement the terms and
   conditions herein, including those relating to the withdrawal or addition of Offers,
   as it deems from time to time, without any prior notice to the Customer.
3. All notices, demands, or other communications are to be made in writing, and shall
   be delivered personally or sent by prepaid post addressed to, in the case of the Company, his or her last known address.
4. Any such notice, demand or communication shall be deemed to have been served in the case of a notice, demand or communication delivered by hand on the day of the delivery and in case of a notice, demand or communication served by registered post on the day following that on which the notice, demand or communication was posted.
5. Upon approved application, customer can either opt for a private PIN number to access or may just pick up the registered number and dial directly.
6. XinTel Sdn Bhd accepts payment made on Visa, Master and Amex Card. The amount due will be directly charged to the designated card and be subjected to the same terms governing the credit account.
7. Block size for charges will vary according to the type of services. Different service will have different charges. The Company shall have the right to vary the block size for charges without any prior notice to the Customer.
8. Charges commences immediately when the other party picks up the phone, regardless of whether it’s a fax machine or answering machine.
9. The Company shall have the right at its sole discretion and from time to time to vary the rates chargeable to the Customer for the use of the service without any prior notice to the Customer.
10. Balance amount upon termination of this account is non-refundable.
11. The customer shall pay RM200nett to replace each dialer which is lost or damaged (not due to normal usage).
12. If any one more of the provisions of this Agreement or any part thereof shall be
    declared or adjudged to be illegal, invalid or unenforceable under any applicable law,
    such illegality, invalidity or unenforceable shall not vitiate any other provisions of this
    Agreement which remain in full force and effect.
13. This Agreement is governed by and shall be construed in accordance with the laws of Malaysia. The Customer irrevocably submits to the non-exclusive jurisdiction of the Courts of Malaysia.
